The $312,500 amount is a liability threshold. It is not a traditional wage base applied separately to each employee.

Who Is Subject to New York MCTMT?

The MCTMT applies to employers with covered employees whose services are allocated to the Metropolitan Commuter Transportation District.

Then:

Total MCTMT = Zone 1 MCTMT + Zone 2 MCTMT

Practical New York MCTMT Payroll Calculation Example

Assume an employer has $650,000 in total MCTD payroll expense during a 2026 quarter.

Of that amount:

$450,000 is attributable to employees in Zone 1.

$200,000 is attributable to employees in Zone 2.

Because total MCTD payroll expense is $650,000, the employer exceeds the $312,500 liability threshold.

For Zone 1, $450,000 falls into the payroll bracket above $437,500 but not over $2.5 million. The applicable rate is 0.60%.

$450,000 × 0.60% = $2,700

$200,000 × 0.055% = $110

Is There a New Employer MCTMT Rate?

New York does not provide a special MCTMT rate for new employers.

Unlike unemployment insurance, there is no separate new employer MCTMT contribution rate.

START-UP NY Businesses

Eligible START-UP NY businesses may receive an MCTMT exemption for payroll expense attributable to employees working in qualifying tax-free NY areas.

The employer must still use total zone payroll when determining the applicable MCTMT rate before subtracting qualifying payroll expense under the exemption calculation.

Professional Employer Organizations

Professional employer organizations, or PEOs, have special calculation rules.

A PEO must determine MCTMT liability separately for its own payroll and for each client under a professional employer agreement. Payroll amounts are not simply combined across every client to determine one rate.

New York MCTMT Rules for Remote Employees

Remote and hybrid employees require careful review because an employee's home address alone does not always determine MCTMT treatment.

New York uses four allocation tests in a specific order.

The first test is localization. An employee's services are allocated to the MCTD when they are performed entirely within the district, or when work outside the district is only incidental to work performed within it.

If localization does not resolve the issue, the employer considers the employee's base of operations.

The next test looks at the place of direction and control. Services may be allocated to the MCTD if direction and control comes solely from within the MCTD and the employee performs some services there.
